HCS SB 1102 -- JEFFERSON COUNTY ORDINANCE AUTHORITY SPONSOR: Alter (Roorda) COMMITTEE ACTION: Voted "do pass" by the Committee on Local Government by a vote of 16 to 0. Currently, Jefferson County may only adopt penal orders or ordinances in the areas of traffic violations, solid waste management, and animal control. This substitute expands the authority of Jefferson County to adopt any penal order or ordinance as long as it is consistent with state law. Any violation can be prosecuted in the county municipal court. The substitute also allows Jefferson County to adopt ordinances regarding the relocation of utility facilities within the rights-of-way of streets, highways, or roads under its jurisdiction, but specifically prohibits ordinances governing railroad companies, telecommunications or wireless companies, public utilities, rural electric cooperatives, or municipal utilities. FISCAL NOTE: No impact on state funds in FY 2007, FY 2008, and FY 2009. PROPONENTS: Supporters say that the bill is needed to address a specific liquid waste problem.
